These Terms of Service ("Terms") govern your use of the NGEN mobile application and the website at www.thechangesystem.org (collectively, the "Services"), operated by The Change System ("we," "us," or "our").
By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Services. We fully expect parents and guardians to be actively involved in their children's online activity. If a user under 18 is creating an account, we expect that a parent or guardian has reviewed the app, its features, and these Terms, and agrees to their child's use of the Services.

Parents & Guardians: We believe parents should be actively involved in their children's online experiences. By allowing your child to use NGEN, you acknowledge that you have reviewed the app and its purpose — connecting young people with positive community opportunities — and that you agree to these Terms on their behalf. You are responsible for monitoring your child's use of the Services.
We reserve the right to refuse service or terminate accounts at our discretion.
You are responsible for maintaining the security of your account and phone number used for authentication. You agree to notify us immediately of any unauthorized access or use of your account.
You agree to provide truthful, accurate, and complete information when creating your account and to keep your profile information up to date. Misrepresenting your identity or age is prohibited.
MentorChips are earned by engaging with opportunities through the NGEN app, such as checking in to events and completing pathways. MentorChip amounts are set at our discretion and may vary by opportunity type.
MentorChips have no cash value and cannot be transferred between users, sold, or exchanged outside of the Services.
MentorChips may be redeemed for rewards offered through community partners. Reward availability, pricing, and terms are subject to change without notice.
We reserve the right to adjust MentorChip balances, void fraudulently earned MentorChips, or modify the rewards program at any time.
Opportunities displayed in the NGEN app are created and managed by community partner organizations. While we strive to ensure all opportunities are safe and appropriate:
If you encounter an unsafe or inappropriate opportunity, please report it through the app or contact us directly.
The Services and all associated content — including but not limited to the app design, logos, text, graphics, icons, and software — are the property of The Change System and are protected by applicable intellectual property laws.
By uploading content to the Services (such as profile photos), you:
We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.
You may stop using the Services at any time. You may request account deletion by contacting us. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate. Any MentorChips associated with a terminated account may be forfeited.
The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, The Change System and its officers, directors, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services, including but not limited to:
Before initiating any formal dispute proceeding, you agree to first contact us at support@thechangesystem.org and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly through direct communication.
If the dispute is not resolved informally within 30 days, you and The Change System agree to resolve any remaining dispute through binding arbitration administered under the rules of the American Arbitration Association (AAA), rather than in court. Arbitration shall take place in Valley County, Idaho, or remotely if mutually agreed upon.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against The Change System.
Notwithstanding the above, either party may bring an individual action in small claims court in Valley County, Idaho, if the claim qualifies for small claims jurisdiction.
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date on this page. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
